 Official Giveaway Rules

1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. The Best Friends Animal Society (“BFAS”) Favorite Things Holiday Giveaway (the “Giveaway”) is subject to all federal, state, local and municipal laws and regulations. Void where prohibited by law.  No purchase is necessary, and a purchase or payment of any kind, including any donation to BFAS will not increase your chances of winning. The odds of winning depend upon the number of eligible entries as determined by BFAS.  This Giveaway is in no way sponsored, endorsed, or administered by, or associated with any social media platform, including but not limited to Facebook, Instagram, Threads, X (f/k/a Twitter).

2. BFAS: The Giveaway is sponsored and administered by BFAS located at 5001 Angel Canyon Rd., Kanab UT 84741.

3. ELIGIBILITY: The Giveaway is open only to legal residents of the United States of America who are twenty-one (21) years of age or older at time of entry. The Giveaway is not open to employees or directors of BFAS, or BFAS employees, directors or officers’ immediate families (defined as spouse, parents, siblings, children as well as the spouses of the parents, siblings, or children).  The winner is subject to the BFAS’ verification of eligibility hereunder.

4. ENTRY PERIOD: The Giveaway entry period will begin at 12:01 AM EST November 1, 2025 – 11:59 PM EST November 21, 2025 (the "Entry Period"). ALL ENTRIES FOR THE PRIZES (defined below) MUST BE SUBMITTED BY THE EXPIRATION OF THE ENTRY PERIOD. Entries received outside of the Entry Period are disqualified.

5. HOW TO ENTER:   The eligible attendees must complete the entry form which can be found in the NOV/DEC Best Friends Magazine or through entry through the link found in BFAS social media posts Nov 17–22, 2025 on @bestfriendsanimalsociety. BFAS will act in good faith to determine the individuals who have met the entry requirements with such individuals being deemed “Eligible.” Eligible individuals who are subject to these Giveaway Rules ("Entrants") will be entered into a random drawing as described in these Official Giveaway Rules for the Prizes.  Only one entry is allowed per adult participant for each Prize.  Entrants must complete the entry form applicable to each Prize. Any attempt to obtain more than the permitted number of entries by using multiple/different email addresses, identities, and registrations or any other method will void all of that participant’s entries and that participant will be disqualified. Entries that are mechanically reproduced, copied, illegible, incomplete, inaccurate, or by any other means which subvert the entry process are void. Incomplete entries or entries not fully complying with these Official Giveaway Rules are subject to disqualification at BFAS’ sole discretion. BFAS is not responsible for lost or misdirected entries.

ALL OTHER ENTRIES ARE NULL AND VOID.

BY PROVIDING CONTACT OR OTHER INFORMATION, ENTRANT CONSENTS TO THE COLLECTION AND STORAGE OF THAT INFORMATION. UNLESS ENTRANT ELECTS TO OPT-OUT, ENTRANT CONSENTS TO RECEIVE MARKETING AND OTHER INFORMATION FROM BFAS AND ITS AFFILIATED PARTIES AND CONTRACTORS. ELIGIBILITY TO PARTICIPATE IN THE GIVEAWAY IS NOT DEPENDENT UPON ENTRANT’S CONTINUED CONSENT TO RECEIVE SUCH MARKETING AND OTHER INFORMATION. ENTRANT’S CHANCES OF WINNING ARE NOT AFFECTED BY SUCH CONSENT. BY PROVIDING CONTACT INFORMATION AND NOT ELECTING TO OPT OUT, ENTRANT CONSENTS TO BEING CONTACTED BY BFAS AND ITS AFFILIATED PARTIES AND CONTRACTORS. The odds of winning depend on the number of eligible entries. The approximate retail value (“ARV”) of the each Prize is Dog Bundle $1,378. Cat Bundle $1,482 and Human Bundle $1,235.   Any difference between the stated values here and the actual face or market values of the Prize will not be awarded or paid. 

7. DRAWINGS:   The winner for each Prize will be selected in a random drawing that is scheduled to occur on or about November 24, 2025.  The random drawing for each Prize will be conducted by an employee or employees of BFAS.  The Winner will be contacted via the email address provided on the entry form.  An Entrant may win more than one Prize.

BFAS will make three (3) attempts to contact the potential winner/s via email at the email address provided on the entry form. Each potential winner is subject to verification of eligibility. If a potential winner of a Prize is disqualified for any reason, BFAS may, at its sole discretion, elect to not attempt to redraw for a new potential winner, leaving the unawarded Prize unclaimed. At the sole discretion of BFAS, any one of the Prizes is non-assignable and non-transferable.  The Winner is solely responsible for payment of all expenses (except those specified as being BFAS’ responsibility under these Official Giveaway Rules) and all taxes, if any, relating to the Prize, including travel expenses. No cash or other substitution may be made, except by BFAS, who reserves the right to substitute the Prize in whole or in part with another Prize of comparable or greater value if the intended Prize is not available for any reason, as determined by BFAS in its sole discretion.

To claim the Prize a Winner must complete, sign, and notarize an affidavit of eligibility, waiver and release form, which will unless prohibited by law, contain a publicity release, which must be returned to BFAS via mail within thirty (30) days of notification postmark (or at BFAS’ sole discretion executed electronically within seven (7) days of the provision of the form). In the event of non-compliance with this time restriction, or if a notification of Prize award is returned to BFAS as undeliverable, the Winner identified by drawing will be disqualified without compensation.

The Winner may waive the right to receive a Prize, in which event the Winner will be disqualified and forfeit all interest in the Prize. The return of any Prize or Prize notification as undeliverable will result in disqualification and the forfeiture of all interest in the Prize. Unless prohibited by law, acceptance of the Prize constitutes permission for BFAS and its respective affiliated parties and contractors to use the posted photograph and material associated with such posting, Winner’s name, address (city and state), and/or likeness in internal and public announcements, and for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including, without limitation, the Internet, without compensation.

8. GENERAL CONDITIONS: By entering, participants agree to be bound by these Official Giveaway Rules and by the decisions of BFAS, which decisions shall be final and binding in all respects. BFAS reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway, acting in violation of these Official Giveaway Rules, or engaging in un-sportsmanlike or disruptive conduct. Any person attempting to defraud or in any way tamper with this Giveaway will be ineligible for the Prize and may be prosecuted to the full extent of the law. If any tampering, fraud, technical error or failure, unauthorized intervention, or other problem that corrupts, impairs, or affects the administration, security, fairness, or integrity of the online portion of the Giveaway, or if BFAS deems it necessary, BFAS may, at its sole discretion, cancel, terminate, modify, or suspend the Giveaway and award the Prize at random among all eligible entries received up to the time of impairment.

ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, BFAS RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES AT LAW OR EQUITY FROM ANY PERSON RESPONSIBLE FOR ANY SUCH ATTEMPT.

9. DISCLAIMERS: By entering, participants acknowledge and agree that BFAS and its respective officers, directors, employees, agents, and representatives of BFAS, or any officers, directors, employees, agents, and representatives from any of the entities or individuals that have provided items to be included as part of a Prize, including but not limited to: 

Ancestry.com DNA, LLC, Automated Pet Care Products, LLC, Barking Labs Corp, Blue Buffalo Enterprises, Inc., Conscious Step Inc., e.l.f. Cosmetics Inc., Flexible Jewelry LLC, Foley Faily Wines, Inc., GoodPop LLC, Hedley and Bennett, Inc., Olive & June LLC, pawTree LLC, RAWZ Natural Pet Food, Inc., Ruggable LLC, The Clorox Pet Products Company, Unique Petz LLC, Vesync Corporation, West & Willow LLC

in addition to any social media platform, including but not limited to Facebook, Instagram, Threads, X (f/k/a Twitter) (collectively, the "Giveaway Releasees"), will not be liable for harm, losses or injuries of any kind resulting from the acceptance/possession/use and/or misuse of Prize, participation in the Giveaway, printing, mailing, or distribution errors, unauthorized human intervention in the Giveaway, errors in the administration of the Giveaway or the processing of entries, or any entries that are tampered with, garbled, incomplete, or otherwise not in compliance with these Official Giveaway Rules. Participants release and agree to hold harmless the Giveaway Releasees from any and all liability from any of the claims described above. The Giveaway Releasees are not responsible for late, lost, illegible, redirected, misdirected, stolen, undelivered, or separated entries or Prize notifications. The Giveaway Releasees are not responsible for any problems or technical malfunctions of any telecommunications network or telecommunications lines, computer on-line systems, servers, computer equipment, telecommunications network equipment, software, failure of any e-mail or entry to be received by BFAS on account of technical problems, human error or any combination thereof.

IN NO EVENT WILL ANY GIVEAWAY RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES, LOSSES, OR HARM OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO A PARTICIPANT’S ENTRY OR PARTICIPATION IN THE GIVEAWAY. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON BFAS’ WEBSITE AND SOCIAL MEDIA PLATFORMS AND IN THIS PROMOTION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO ALL PARTICIPANTS.

10. TAX CONSEQUENCES: In the event BFAS determines in its sole discretion that the value of the Prize is over $600, Winner is required to provide the necessary information in order for BFAS to issue a 1099 form in a timely manner.  The Winner is solely responsible for determining any requirements for reporting the value of the Prize as the Winner’s income for any applicable state or federal tax return.

11. GIVEAWAY WINNERS LIST: To request the name and state of the Prize Winner (to the extent such information may be disclosed as permitted by applicable law) and/or a copy of these Official Giveaway Rules, send a self-addressed, stamped, business-size envelope to BFAS at Best Friends Animal Society, Attn: Corporate Relations 5001 Angel Canyon Rd. Kanab, UT 84741. Indicate whether you are requesting the name of the winner and/or a copy of Official Giveaway Rules. Requests for such information must be received by November 25, 2025.
